The game needs a duel mechanic in general. Yes its a good griefing tool but its still important to have in the game. Now if someone wants to duel they have to go grey outside town. Which is likely to end significantly more poorly than dueling in town.

If the duel ends upon entering mercy mode, then you'll loose rep and become criminal if you kill the person you are dueling with. Which would make using it to trick people into dying harder and punishable. Do the duels near towns and the guy will lose at a minimum 2 rep just to get some shitty gear.
